Hon. John Amaratunga,— To ask the Minister of Lands and Land Development,—
(a) Will he state whether—
(i) the Sections 63(1) to 63(4) of the Land Acquisition Act No. 09 of 1950 have been violated by the Regulations published in the Gazette (Extraordinary) No. 1596/12 dated April 07, 2009 ;
(ii) the aforesaid Regulations are binding or of any force;
(iii) the said Regulations have been approved by the Parliament and made in accordance with the Section 63(3) of the aforesaid Act; and
(iv) they are unlawful and invalid?
(b) Is he aware that—
(i) the Regulations referred to in (a) (i) have been unlawfully published in the Gazette disregarding the Parliamentary approval mandated by the Section 63(3) of the Land Acquisition Act; and
(ii) the right to have payment of the market value for the lands acquired for public purposes have been deprived and denied by the aforesaid Regulations?
(c) Will he also state whether a Gazette notification will be issued afresh, cancelling the Regulations imposed by the Gazette No. 1596/12 of April 07, 2009?
(d) If not, why?
