Hon. (Dr.) Nalinda Jayathissa,— To ask the Minister of Education,—
(a) Is he aware—
(i) a section of officers have been granted appointments for the post of Principal with effect from 13.11.2009 for a section of officers based on the Principal’s Service Minute published in the Gazette Extraordinary dated 02.07.1999 and No. 1086/26, having gazetted in 2005 and conducting a competitive examination in 2006;
(ii) appointments for Principals have been granted in 2010, 2012 and in 2014 as per the court ruling No. 212/2010/FR and dated 26.01.2012 based on that competitive examination; and
(iii) whether that though these appointments were given according to the service minute published in the Gazette Extraordinary No. 1086/26 and dated 02.07.1999 and, in granting the promotions, the conditions in the new service minute published in the Gazette Extraordinary No. 1885/31 and dated 22.10.2014 are applicable?
(b) Will he admit that—
(i) it is unfair to grant appointments from time to time throughout a number of years for a group who faced the same examination; and
(ii) it is unfair to offer promotions based on the new service minute and subject them to new conditions with retrospective effect?
(c) If not, why?
