Hon. Rajiva Wijesinha,— To ask the Minister of Justice,—
(a) Is he aware that under the Prevention of Domestic Violence Act,—
(i) the Court shall issue an Interim Protection Order upon an application, until the inquiry into the application is concluded;
(ii) an order shall be made by the Court to hold an inquiry on such application within 14 days from the date of application; and
(iii) an Interim Protection Order shall remain in force for a period not exceeding 12 months ;
(b) Will he state—
(i) the cases in which, no inquiry was held and inquiries were held after the specified period;
(ii) the remedial action that will be taken to guide the Magistrates, who have failed to apply the law and the compensation to be paid for the victims of delays ;
(iii) the reasons for having a terminal date for a Non-Interim Order whereas no such date for an Interim Order; and
(iv) whether steps will be taken to correct the aforesaid anomaly?
(c) If not, why?
